Rules Regarding Dog Bite Lawsuits
Chattanooga Dog Bite Lawyer
General Rules
The rules regarding dog bite law vary according to state, county, and city. Generally speaking, all states maintain that a person is responsible for a dog bite if he or she made the dog attack the victim, or if they knowingly kept a dog that had previously injured others or had shown a tendency towards violent behavior.
How to Determine Liability When No State Statute Exists
In states which do not have dog bite statues, otherwise known as "one-bite" states, legal liability is determined by the following principles:
- Has the dog bitten someone before? If so, the owner is strictly responsible.
- If the dog has never bitten anyone, has the dog ever shown behavior that should have warned the owner of the dog's aggressive nature?
- If the dog has never shown violent warning signs, was the owner violating any public health or safety regulations intended to protect people such as the victim?
Who pays for the damages?
Typically, monetary damages in a dog bite injury case are covered by one of the following:
- Homeowner's insurance
- Renter's insurance
- Landlord's insurance
- Commercial general liability insurance
- Insurance covering employers
- Motor vehicle insurance (if the accident results from the use of a vehicle)
What happens to the dog?
Generally speaking, nothing will happen to the dog, other than that it might be quarantined for several days. If the attack is brutal, or other special conditions are met, a court may order that the animal be confined or put down. For more information specific to Chattanooga, contact Johnny L.
